The present petition under Section 482 of the Code of Criminal Procedure has been filed for quashing of FIR No.90 dated 03.11.2016, registered under Sections 420, 406, 120-B and 34 of the Indian Penal Code, 1860, (for short, 'IPC'), at Police Station Sujanpur Tehsil and District Pathankot, and all other consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2.

Reply dated 24.02.2020 by way of affidavit of Sukhjinder Pal Singh, PPS, Deputy Superintendent of Police, Sub-Division, Dhar Kalan, Pathankot, has been filed on behalf of respondent No.1-State. The same is taken on record.

Vide orders dated 04.04.2022 and 24.02.2023, the parties were directed to appear before the learned trial Court/Illaqa Magistrate, for getting their statements recorded; as to the genuineness of the compromise. In compliance thereof, reports of the Judicial Magistrate Ist Class, Pathankot, dated 15.06.2022 and 03.04.2023, have been received, wherein, it has been submitted that respondent No.2/complainant did not appear before the Trial Court to record his statements.

Today also, there is no representation on behalf of respondent No.2.

Learned counsel for the petitioners prays for withdrawal of the present petition.
