***** Rajan Gupta, J. (Oral) Learned State counsel submits that the order passed by the writ court has been complied with. He has referred to Paras 03 and 04 of the affidavit dated 11.05.2017, which read as under:- "03. That the office of the District Education Officer, Kaithal, has made the payment in respect of the arrear of the revise pension according to EPS no.1400058769 dated 21.04.2017 (Annexure R-1) and the payment of the arrear of the revised gratuity has made by the Manager, A.S. High School Pundri on dated 01.04.2017 and 06.04.2017 (Annexure R-2).
04. That further it is also mention here the revision cannot be made in respect to the petitioner no.4 i.e. Krishan Kumar Khurana, reason being he had been retired from services on superannuation on 31.01.2009 and the petitioner no.4 is already getting the benefit of total length of his qualifying service i.e. 22 years 7 Sukhpreet Kaur 2017.05.25 16:22 I attest to the accuracy and integrity of this document

months and 30 days, according to the notification vide which the benefit has been revised w.e.f. 01.08.2011. That admissible benefit has been credited in the bank accounts of the eligible petitioners and nothing is due." In view of the above, no cause of action survives in this petition. Same has been rendered infructuous and is dismissed as such. Rule is discharged.
