Petitioner is a decree holder in a suit for possession of open piece of land, fully described in the suit, as also an injunction order restraining the private defendants from raising any future construction on the suit land. In the execution filed by the petitioner/plaintiff, Gram Panchayat Hasanpur, he filed third party objections claiming to be owner in possession. It is averred that the said objections and the execution petition were dismissed and the order duly upheld in a revision by this Court. It is conceded that the decree qua possession stood duly executed by deliverance of possession on 4.2.2012. It is contended that now after almost six years, Gram Panchayat is threatening the peaceful possession of the petitioner/ decree holder of the aforesaid suit land by installing cemented poles etc. It is not disputed that there was no injunction decree against Gram Panchayat although they had resisted deliverance of possession to the petitioner/plaintiff.
