(ORAL) The petitioner is seeking anticipatory bail in case FIR No. 28 dated 02.02.2018, registered under Sections 406, 420, 120-B IPC, at Police Station Sadar Yamuna Nagar.

Learned counsel for the petitioner submits that the petitioner has entered into a mutual settlement with the complainant and pursuant thereto a compromise deed dated 18.12.2020 (Annexure P-2) has been executed. Learned counsel also relies on an affidavit dated 18.12.2020 (Annexure P-3) deposed by the complainant in support of the said compromise. He further submits that pursuant to order dated 15.01.2021 passed by this Court, the petitioner has joined investigation and has fully cooperated in the same.

Learned State counsel, per his instructions from ASI Balinder Singh, submits that petitioner has joined the investigation and no custodial interrogation of the petitioner is required. He submits that the matter has indeed been compromised between the parties.

In view of the above, the petition is allowed. Order dated 15.01.2021 granting interim anticipatory bail to the petitioner is made absolute, subject to the petitioner's complying with provisions under Section 438 (2) Cr.P.C.
