(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing DDR No.27 dated 12.03.2016 registered under Sections 323, 324, 452, 506, 148 and 149 IPC, Police Station Singh Bhagwantpur, District Rupnagar (P-1) recorded in FIR No.22 dated 12.03.2016, under Sections 323, 324, 148 and 149 IPC, Police Station Singh Bhagwantpur, District Rupnagar and all subsequent proceedings arising therefrom, on the basis of compromise. Pursuant to order dated 24.01.2019 of this Court, the parties appeared before the trial Court on 16.02.2019 along with receipt of `15,000/- to get their statements recorded. Learned Civil Judge (Jr. Division)-cum-JMIC, Rupnagar, has submitted her report vide letter bearing No.80 dated 26.02.2019 duly forwarded by learned District and SONIKA 2019.03.11 16:47 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-3283 of 2019 --2-- Sessions Judge, Rupnagar, vide Endst. No.2763 dated 27.02.2019. According to the report, ld. Civil Judge (Jr. Division)-cumJMIC, Rupnagar is satisfied that compromise entered into between the parties is genuine and voluntary and the same has been effected between the parties out of their free will and consent, without any threat or pressure or undue influence. No accused has been declared proclaimed offender.
Considering the report of ld. Civil Judge (Jr. Division)-cumJMIC, Rupnagar dated 26.02.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid DDR No.27 dated 12.03.2016 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only. Disposed of accordingly.
