An opportunity had been given to the defendant already by this Court allowing for the written statement to be filed and opportunity given to the defendant to examine the plaintiff and the witnesses which had been closed. Accordingly, the Court below has allowed for the writtten statement to be filed and has also given the defendant the opportunity to cross-examine the plaintiff's witnesses. After the conclusion of the witnesses, the plaintiff has produced additional evidence and the defendant has aggrieved that the order already passed by this Court did not contemplate examination of further witnesses by the plaintiff. If after the cross-examination of the witnesses of the plaintiff, there is any issue that has arisen and that would require further evidence to be given, this order did not surely foreclose such an occasion for the plaintiff to produce further evidence.
