******* SURINDER GUPTA, J.(Oral) These are the petitions filed under Sections 10 and 12 of the Contempt of Courts Act for punishing the respondents for willful disobedience of order dated 17.10.2014 passed by this Court in petition CRM-M-35768-2014.
Order dated 17.10.2014, reads as follows:- "It is claimed that petitioner has been involved in 11 cases. Petitioner has been involved in 8 cases after March 10,
-22014.
Through instant petition, he seeks protection of life and liberty.
Notice of motion to respondents No.1 and 2 for December 22, 2014.
Meanwhile, an interim direction is issued that in case petitioner is required to be arrested in any case registered after October 17, 2014, the matter will be inquired into and investigated by Special Investigation Team constituted by respondent No.2. In case, petitioner is required to be arrested in any criminal case prior to October 17, 2014, besides the 11 FIRs against the petitioner, he would be given a seven days notice before his arrest to enable him to avail the legal remedy available to him.
The report regarding requirement of the petitioner as an accused in any case registered before or after October 17, 2014 be submitted by next date of hearing."
Learned State counsel submits that petitioner after passing of order dated 17.10.2014 was not arrested in any case, as such, there was no contempt of order dated 17.10.2014.
Learned proxy counsel appearing for Mr. R.K. Girdhar, Advocate was asked to assist this Court by referring to any paragraph of petition, where petitioner has alleged that he was arrested after passing of order dated 17.10.2014. He has referred to paragraph no. 10 of petitions, wherein it has been mentioned that in a case bearing FIR No. 69 dated 05.05.2014, registered at Police Station Cantt. Ferozepur, the petitioner was
-3arrested and was released on bail vide order dated 25.07.2014 passed in CRM-M-23551-2014 i.e. before the passing of order dated 17.10.2014. Thereafter, he has not been arrested in any case. Learned State counsel has submitted that the petitioner absconded after his release on bail and the process to declare him proclaimed offender is under way.
