Mr. Arjun Partap Atma Ram, Advocate for the petitioner. JASWANT SINGH, J (ORAL) The petitioner, who was working as Professor on substantive basis, had filed a writ petition bearing CWP No.14639 of 2015, challenging the retrospective dates of promotion and seniority granted to others in the rank of Professors, which stands admitted with an interim direction to the effect that the promotion order from retrospective date of any of the private respondents, as detailed in Annexure P.1, would not be given effect to for consideration for being designated as Head of the Department. The petitioner by filing this contempt petition has alleged that the respondent-University has committed contempt of courts by passing an order dated 20.3.2017 (P.7), whereby Dr.Manoj Kumar Sharma, Professor has been designated as the Chairperson/Head of University Business School w.e.f 01.4.2017 for a period of three years.

At the time of hearing today, learned counsel for the petitioner points out that the respondent-University has withdrawn the earlier contemptuous order (P.7) and in place has passed a fresh order dated 23.3.2017 (P.14), in order to circumvent the directions thereby designating some of the respondents as Administrative Heads. He, however, prays for permission to withdraw the present contempt petition with liberty to file a fresh one with better particulars.

Dismissed as withdrawn with the liberty aforesaid. Rule is discharged.
