The plaintiffs who have not given their objections about laying of overhead lines before the Executive Magistrate cannot have a case of injunction before the Civil Court. The two Courts below have declined the interim relief.

The counsel points out to me that this Court has passed an order in another case where the plaintiff has been protected in his electrical installations being drawn overhead till the disposal of case before the Deputy Commissioner/Magistrate. In a situation where there have been proceedings before the Magistrate or where the parties have availed of a remedy through an objection, if I have passed an order, that cannot be an example for the plaintiffs to arrive directly to the Civil Court to seek for injunction. The plaintiffs will not have similar remedy of what was available in yet another case.

I decline to make any intervention. The revision petition is dismissed.
