The petitioner is fair to admit that there is a structure over the plot which is agreed to be sold. If that is the truth, there can be no prejudice to amendment being brought in the written statement to that effect. The counsel, however, wants permission to rebut the nature of building which the defendant has stated in the written statement. The plaintiff will have the liberty to give a rebuttal statement to rejoinder to the amended written statement. In respect of the averment brought through a rejoinder, the plaintiff will also have the benefit of additional evidence to be given and the Court will allow for such liberty and right of cross-examination to the defendant as well. 2.
