***** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner in a case arising from FIR No.265 dated 09.09.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances, 1985 (for short, "Act") at Police Station Sadar Sirsa, District Sirsa.
According to the prosecution, on 09.09.2018, 900 tablets of Parvorin-spas (Tramadol Hydrochloride) were recovered from the conscious possession of the petitioner along with his co-accused namely Manjeet Singh.
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is SONIKA 2019.01.25 17:47 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-2594-2019 --2-- in custody since 09.09.2018. Moreover, co-accused of the petitioner namely Manjeet Singh and Lokesh Kumar have already been granted interim bail till receipt of FSL report. Treating the case of the petitioner on the same party, he may also be granted interim bail. In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to his furnishing personal bonds and two sureties of `2.00 lakh each to the satisfaction of the trial Court/Duty Magistrate, concerned only till receipt of the FSL report.
The petition stands disposed of accordingly.
