**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through videoconferencing. Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.607 dated 17.11.2020 registered under Sections 147, 149, 323, 324, 354-B, 379-B, 452, 506 IPC, Section 25 of the Arms Act and Section 3 of the SC/ST Act at Police Station City Narnaul, District Mahendergarh (During investigation, Sections 354-B, 379-B, 452 IPC have been deleted).

Notice of motion was issued on 15.01.2021 and arrest

of the petitioner was stayed. Thereafter, vide order dated 19.07.2021, the petitioner was directed to join the investigation. During investigation conducted by DSP, Narnaul, offences under Sections 354-B, 379-B and 452 IPC were deleted. The injury on the leg of the complainant was not on account of any gun shot injury. No firing was proved to have been done. No empty cartridges were found at the spot. The allegations of dragging, utterances and touching the wife of the complainant in an inappropriate manner, were only after entering the house of the complainant. Since the offences under Sections 354-B, 379B and 452 IPC were deleted, therefore, the petitioner was directed to join the investigation.

Learned counsel for the petitioner submits that the petitioner has joined the investigation in compliance of the order dated 19.07.2021 to the entire satisfaction of the investigating officer.

Learned State counsel on instructions from DSP Narender Kumar admits that the aforesaid fact and submits that the petitioner is no more required for further investigation in the case.

In view of statement made by learned State counsel, the interim order dated 19.07.2021 is made absolute. Petitioner shall keep on joining the investigation as and when required to

do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Petition stands disposed of.
