The petitioner has sought for amendment to the issues framed. I have examined the issues and it is purely consequential to the amendment which was already permitted to be taken before this Court. While allowing the benefit of amendment to the plaintiff, I had allowed the defendant to file additional written statement under Order 8 Rule 9 CPC and also gave him liberty to cross-examine the plaintiff. The defendant's right must be taken as fully protected. The issues which are now sought to be framed are not merely consequential but also places the burden on plaintiff himself to establish what he has asserted. I find no prejudice as having resulted to the defendant. 2.
The order passed is perfectly justified and the revision petition is without merit. It is dismissed.
