Mr. Sharad Aggarwal, Advocate, for Mr. Lokesh Sinhal, Advocate, for the petitioner. ***** RAKESH KUMAR JAIN, J. (ORAL) After arguing for some time, learned counsel for the petitioner submits that he would not press this revision petition on merits, rather he prays for grant of two years' time to vacate the demised premises, as the petitioner/tenant has to shift its factory to another place. In view of above, the present revision petition is hereby dismissed on merits. However, the petitioner/tenant is granted nine months' time from today to vacate the demised premises i.e. on or before 26.11.2015.

This order shall operate subject to filing of an undertaking by the petitioner/tenant in this regard before this Court within 30 days and also on making payment of the entire arrears of rent, if any due, within a period of 4 weeks from today and shall also keep on paying the rent of ensuing months up to 26.11.2015 to the respondent/landlord on or before every 10th of each calendar month.

It is needless to mention that in case of any violation of the undertaking, which is to be furnished by the petitioner/tenant before this Court, not only the above arrangement would stop operating but also the Managing Director of the petitioner-company would make himself liable for action under the Contempt of Courts Act, 1971.
