The petitioners who wanted to assail judgment of the trial Court that the valuation of court fee at the appellate court shall not be the same as it was already done in the trial Court. The contention is that the suit property is ancestral and the agreement of sale will not bind their interest. In my view, it will be futile to argue that the property is ancestral and they were not parties to the agreement and that therefore, there is no need to set it aside. If the decree for specific performance is assailed before the Appellate court, it is bound to be valued in the very same manner that the plaintiff had made valuation. There is no defect in the order directing the petitionersappellants to pay the court fee in the manner it was assessed at the trial Court.

The revision petition is dismissed.
