RAKESH KUMAR JAIN,J (ORAL) This order shall dispose of two cases bearing CP No.76 of 2014 and CAPP No.15 of 2014.

An application bearing CA No.182 of 2016 is filed in CP No.76 of 2014 and CMA Nos.39-40 of 2016 in CAPP No.15 of 2014 under Rule 6 and 9 of the Companies (Court) Rules for withdrawal of the petition and the appeal in view of the compromise arrived at between the parties on 26.3.2016. Sh. Anil Kumar Aggarwal, learned counsel for the petitioner in CP No.76 of 2014 has submitted that in view of the

CP No.76 of 2014 (O&M) and #2# CAPP No.15 of 2014 compromise, all the disputes between the parties have been settled and in case of any breach of the terms of the agreement, default clause No.10,11 & 12 of the agreement would be operative.

Sh. Mukul Aggarwal, learned counsel for the respondents in CP No.76 of 2014 has owned up the statement made by learned counsel for the petitioners.

Consequently, the present applications bearing CA No.182 of 2016 and CMA Nos.39-40 of 2016 are hereby allowed and CP No.76 of 2014 and CAPP No.15 of 2014 are dismissed as withdrawn.

It is needless to mention here that with the disposal of CAPP No.15 of 2014, order passed in CP No.10 of 2007 before the Company Law Board, New Delhi would also become infructuous.

A photo copy of this order be placed on the file of connected case.
