Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 116 dated 28.05.2017, registered under Section(s) 336 IPC and Sections 25, 27, 54 & 59 of the Arms Act, 1959 at Police Station Sultanwind, Commissionerate Amritsar, District Amritsar.

Learned counsel for the petitioners contended that both the petitioners were earlier admitted to regular bail by the learned trial Court; thereafter, they could not appear on the date fixed as they had gone out along with their trucks as by profession they are drivers; they could not intimate the learned Court even; in that process, they were declared as proclaimed offenders and they are ready to appear before the learned trial Court and face trial regularly.

Criminal Misc. No. M-1884 of 2019 On asking of the Court, Mr. Ajay Pal Singh Gill, Deputy Advocate General, Punjab accepts notice on behalf of respondent. A complete copy of paper-book be provided to him during the course of the day.

In view of above, present petition stands disposed of with the directions that petitioners shall surrender before the learned trial Judge and on their doing so, the learned trial Court admit them on fresh bail on their furnishing fresh bail bonds with two sureties, for each petitioner, to its satisfaction. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioners. (Shekher Dhawan) Judge January 17, 2019 "DK"
