*** Daya Chaudhary, J. (Oral) Learned counsel for the petitioner submits that in pursuance of order passed by this Court on 06.03.2017, the amount of gratuity has not been paid and only photocopy of the draft has been annexed with the reply. It has also not been conveyed as to how the calculation has been made. Learned counsel for the respondent has handed over the draft to learned counsel for the petitioner but finding that the name is not correctly mentioned, the same is returned for correction due to spelling mistake in the name.

Learned counsel for the respondent undertakes to give the draft on 10.04.2017. Learned counsel also submits that the arbitration proceedings are pending whereas learned counsel for the petitioner submits that no such proceedings are in his knowledge. It cannot be said at this stage as to whether the proceedings are Neetu Rani 2017.04.17 12:04 I attest to the accuracy and authenticity of this document Chandigarh

COCP No.86 of 2017 pending or not. The petitioner is at liberty to avail the appropriate remedy in case, any such proceedings are pending. The petitioner is also directed to collect the draft on 10.04.2017.

The respondent is also directed to communicate as to how the amount has been calculated.

Disposed of accordingly.

However, it is made clear that payment of amount released to the petitioner would be subject to decision of the arbitration proceedings, if not stayed by any Court.
