Learned counsel for the respondents reiterates that possession of the demised premises has been handed over to the respondents-landlords in execution proceedings. Reference is made to order dated 17.04.2015 passed by the learned Additional Chief Judicial Magistrate, Jalandhar whereby the execution application was dismissed as withdrawn. It is further noticed that learned counsel for the petitioner had sought an adjournment to verify the factum of handing over of possession as is mentioned in order dated 23.03.2018. CR No.1269 of 2015(O&M) [2] the another tenant, listed for today itself, has been withdrawn on the ground that vacant peaceful possession of the premises has been handed over to the respondents-landlords.
Today, despite this matter being called twice, there is no representation on behalf of the petitioner. It appears that the petitioner is not interested in pursuing the matter any longer. Petition is accordingly dismissed in default. ( LISA GILL ) May 03 , 2019.
