The plaintiff whose side was closed after affording five opportunities to tender his evidence is aggrieved that the Court should recall the order to allow for the witnesses to be continued for crossexamination. The Court has justified its decision by the fact that the plaintiff had not effectively utilized the opportunities granted to him. 2.

I dispense with notice to the respondents to see that no further delay is caused and allow for the opportunity to be given to the plaintiff on payment of costs of `10,000/- to be paid to the contesting defendant within a period of two weeks from the date of receipt of copy of this order. If the amount is not paid, the order already passed will stand confirmed.

The revision petition is disposed of with the above observations.
