A judgment delivered in yet another suit was sought to be produced as additional evidence. The trial Court has declined the same. I set aside the order and direct the document to be received without any proof since it is a matter between the same parties. I dispense with notice to the respondents having regard to the nature of order that the plaintiff cannot be put to surprise, for he ought to have known about the dismissal of his own suit against the very same defendant. 2.

The order impugned is set aside and the revision petition is allowed.
