Mr. Rakesh Kumar, Advocate for the petitioner. HARSIMRAN SINGH SETHI, J (ORAL) Learned counsel for the petitioner states that the relief qua entitlement of the petitioner in respect of 50% of the family pension has already been decided by the Competent Authority on 28.12.2016. As per the said order, one eligible child of the petitioner shall be entitled for 50% of the family pension w.e.f March 2003 i.e after the date of her remarriage with Natha Singh till the eligible child gets employed or get married or attains the age of 25 years (in case son only), whichever event occurs earlier. He states that the said pension has not been released so far and that even an affidavit has already been sworn by step son of the petitioner that he does not have any objection qua grant of family pension in favour of the petitioner.
He states that there is no dispute between the family with regard to grant of family pension to the petitioner. Having argued the matter at some length, learned counsel prays for withdrawal of the petition with liberty to file proper/fresh representation to the respondent Department bringing out the aforesaid facts including the MANOJ KUMAR 2019.02.
CWP No.1963 of 2019 #2# fact of filing of affidavit by step son of the petitioner in her favour. Dismissed as withdrawn with the liberty as prayed for. In case the said representation is filed by the petitioner within four weeks from today, the same shall be decided by the Competent Authority within next three months.
