The petitioner's contention is that a compromise/receipt filed in the Executing Court was rejected even without affording any opportunity to let in evidence in that regard. I dispense with notice to the respondent and direct the Executing Court to permit the petitioner to give evidence as regards the compromise/receipt and render an adjudication on the evidence given.

The impugned order is set aside and the matter is remitted to the Executing Court for consideration in the light of directions made above. The issue of whether arrest will be made or not will be taken subsequent to the adjudication as directed above. (K.
