The petitioner seeks quashing of FIR No.44, dated 5.4.2018 registered at Police Station Jandiala, District Amritsar Rural, under Sections 420, 406, 120-B of Indian Penal Code, wherein offences under Sections 409, 467, 468, 471 of IPC and Sections 13(1)(D) and 13(2) of Prevention of Corruption Act were added later on.

Learned State counsel has informed that in the present case investigation stands concluded and challan already stands presented and the matter is now at the stage of consideration as regards framing of charges. It has also been informed that another case arising out of same FIR i.e. CRM-M-23366-2022 was also fixed in the urgent motion today at serial No.111, wherein a liberty has been granted to the petitioner to raise all the pleas as have been raised herein, before the trial Court at appropriate stage. Having regard to the aforestated position, this Court is of the opinion that all the pleas as have been raised herein in the present case be raised before the trial Court at the stage of framing of charges. 4.

In case, any such plea is raised before the Trial Court, the Trial Court shall consider the same by passing a speaking order. 5.
