It is submitted in the present petition that the marriage of the sister of the petitioner, namely Sapna, was performed with one Amit on 12.02.2023 but he and his family members were not happy with the marriage. They were subjecting her sister to cruelty on account of demand of dowry. on 29.06.2023 at about 09:00 AM, her sister went missing from the fields, where she was working with her in-laws. The petitioner suspected that she might have been kidnapped by her in-laws. On 30.06.2023, the dead body of his sister was recovered from the canal near village Jaisingpur. conducting proper investigation in the matter and no action is being taken against the accused persons.

Learned State counsel, appearing on advance notice, submits that the police has conducted a proper, fair and impartial investigation in the matter and aforesaid Amit, who was the husband of the deceased, has been arrested. He further submits that after completion of investigation and usual formalities, challan has been presented in Court on 30.09.2023. While submitting that there is no merit in the present, he has argued that the present petition is liable to be dismissed.

I have heard learned counsel for the parties and have gone through the record.

The prayer made in the present petition is for issuing appropriate direction to the respondents to conduct a proper investigation in the matter and take action against the accused persons. It is admitted fact that the husband of the deceased has since been arrested and after completion of investigation and usual formalities, challan has been presented in Court on 30.09.2023. The trial must be going on. Keeping in view the aforesaid facts, this Court finds no merit in the present petition. Accordingly, the same is dismissed.    (MANISHA BATRA)
