Learned counsel for the respondent submits that in pursuance of the order passed by this Court on 02.12.2016 in CWP No.24916 of 2016, the claim of the petitioner has been considered and the benefits, for which the petitioner was found entitled, have been released to him. Learned counsel for the petitioner submits that there was delay in releasing the amount, therefore, the petitioner is also entitled for interest. Learned counsel also submits that some amount has been deducted/recovered without any reason.

Since the direction was to consider the representation and to release the amount within a period of one month from the date of receipt of certified copy of the order but there is delay in releasing the amount. It was also mentioned in the order that a speaking order was to be passed but no such order has been passed.

77  The petitioner is at liberty to move representation for claim of interest on delayed payment as well as the benefits, which have not been granted to him. In case, such representation is made within a period of two weeks from the date of receipt of certified copy of this order, the respondent is directed to consider the same and pass a detailed speaking order within a period of two weeks thereafter. In case, the petitioner is found to be entitled for the relief claimed in the representation, the same be released to him within a period of two weeks thereafter.

Disposed of accordingly.
