KANNAN, J (ORAL) Application for restoration, which was dismissed in default, was sought to be restored but there was delay of 22 months in filing the application. Petitioner led no evidence and the Court dismissed it. Suit was for recovery of Rs.71285/-.
Application is ordered to be restored. The Court will not waste time in calling the parties for evidence for restoration of interlocutory application in interlocutory application. It shall act on the material available on record and pass orders within two weeks from the date of receipt of papers.
Revision is allowed on the above terms.
