HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.586 dated 14.09.2020 under Sections 379-B,201,34 IPC registered at P.S City Yamuna Nagar, District Yamuna Nagar.

Petitioner is accused in the said FIR. Vide order dated 31.08.2021 passed by this Court in CRM-M-19349-2021, the petitioner was directed to be released on bail.

It is the case of the petitioner that on 13.09.2021, due to certain unavoidable circumstances, he could not put in appearance before the learned trial Court because of which his bail bonds and surety bonds were cancelled with his presence being secured through non-bailable warrants. Thereafter vide order dated 25.04.2022, petitioner was declared as proclaimed person. He was arrested subsequently on 21.05.2022 and since then, he is in custody. Learned counsel for the petitioner states that his non-appearance was not intentional but due to circumstances beyond his control. She undertakes that henceforth the petitioner shall appear before the learned trial Court on each and every date as directed.

CRM-M-1761-2023 #2# Without commenting anything on the merits of the case and also bearing in mind the facts of this case, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Furkan is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
