ARUN MONGA, J. (ORAL) Petition herein is under Article 226 of Constitution of India seeking issuance of a writ in the nature of mandamus directing the respondents to decide the representation dated 13.10.2020 (Annexure P-12), given by the petitioner, seeking appointment on compassionate ground, as father of the petitioner died in harness.

Learned counsel for the petitioner submits that father of the petitioner was posted as Village Development Officer/Panchayat Officer in the office of Block Development and Panchayat Officer at NurpurBedi, District Rupnagar. He met with an accident and died on 31.10.2010 before his retirement. He submits that the claim of the petitioner for compassionate appointment is on the basis of a Scheme framed by Punjab Government vide letter dated 21.11.2002.

Learned counsel for the petitioner furtherrelies on Division Bench judgment of this Court rendered in CWP No.18110 of 2009 decided on 19.10.2011 (Annexure P-10) to contend that married daughter is equally entitled, just like a son,to seek employment on compassionate ground. relies on the judgment of this Court in CWP No.2218 of 2017 decided on 17.01.2020 (Annexure P-11). He submits that petitioner approached the respondents time and again but to no avail. Thereafter, petitioner submitted a representation dated 13.10.2020 through e-mail but the same has also not been adverted by the respondents till date. Hence, the writ petition. 4.

Mr. Abhaypal Singh Gill, AAG, Punjab who has joined proceedings on service of advance copy of the petition appears and accepts notice on behalf of the respondent-State of Punjab. 6.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the pending representation dated 13.10.2020 (Annexure P-12) and also by treating the instant petition as supplementary representation and pass a speaking order, in accordance with law,by keeping in view the contentions raised herein.
