**** ALKA SARIN, J. (ORAL) This is the second petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the petitioner in FIR No.115 dated 27.05.2020 under Sections 436 and 506 of the Indian Penal Code, 1860 registered at Police Station, Sadar Narwana, District Jind. Learned counsel for the petitioner contends that the petitioner has falsely been implicated in the case and there is no recovery which has been effected from him and further there is no eye witness of the said incident.
Learned State counsel on instructions from SI Krishan Kumar has stated that the petitioner has specifically been named in the FIR. She further contends that the petitioner had set ablaze the house of his brother Parveen by pouring petrol. She further contends that the petitioner is a habitual offender and there are as many as 12 cases pending against him, out of which he has been convicted in 06 cases. CRM-M-2256-2021 -3In the present case, the allegations are that the petitioner herein had set on fire the house of his brother (complainant) Parveen by pouring petrol on 23.05.2020 at about 7:00/8:00 PM at Village Lochab. The petitioner has specifically been named in the FIR by the complainant. Further, the petitioner in the present case is averred of being a habitual offender and is also involved in 11 other cases out of which he has been convicted in 06 cases.
Keeping in view the above, I do not find this to be a fit case for grant of bail.
The petition is dismissed, accordingly.
