There was a private contract between the petitioner-private company and a public company-Indian Drugs and Pharmaceuticals Limited for purchase and supply of medicines. The contract is stated to have been suddenly terminated vide order dated 23.12.2016 without any opportunity of hearing, as required by the terms and conditions of the contract, before such termination.

Writ petition bearing CWP 10911/2017 filed by the petitioner company, supplier of the medicines, was disposed of on the statement of counsel for the public company that personal hearing would now be afforded.

It is alleged that neither any meaningful hearing has been extended nor any decision taken. However, it is conceded that the matter falls within private domain for which proper remedy would be to seek damages either by invoking arbitration clause or by filing a civil suit in accordance with law.
