IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM-M-2295-2021 Date of decision: - 28.01.2021 Rohtash ....Petitioner

Versus

State of Haryana .....Respondent CORAM : HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI Present:- Mr. Sandeep Singh Jattan, Advocate for the petitioner.

Ms. Rajni Gupta, Additional Advocate General, Haryana. ( Through Video Conferencing ) **** HARSIMRAN SINGH SETHI , J. (ORAL) Present third petition has been filed under Section 439 Cr.P.C for the grant of regular bail to the petitioner in respect of FIR No.233 dated 17.07.2019, under Sections 363 & 366-A of IPC, Section 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes Act, 2012, registered at Police Station Jind Sadar, District Jind. Learned counsel for the petitioner argues that the prosecutrix as well as the complainant have already been examined and therefore, keeping the petitioner behind the bars now, serve no purpose as he cannot interfere into the trial by intimidating the material witnesses. CRM-M-2295-2021 -2Learned State counsel submits that only four witnesses are to be examined, who have been now summoned for 24.02.2021 and all the endeavours will be made to examine the said witnesses and to conclude the trial at the earliest.

Faced with this situation, learned counsel for the petitioner submits that he does not press this petition for the grant of regular bail, but will pray that the trial Court be directed to conclude the trial in a time bound manner keeping in view the facts and circumstances of this case. As the petitioner is not pressing his prayer for the grant of bail and is only praying that the trial be concluded in a time bound manner, the trial Court is directed to examine the remaining four witnesses at the earliest, if possible, on the next date of hearing itself i.e. 24.02.2021 and conclude the trial within a period of next six months.
