ANIL KSHETARPAL, J(Oral) Learned counsel for the petitioners submits that this revision petition was filed by his father late Sh. Padam Jain, Advocate, who has since died. He has further submitted that his effort to contact his client have not borne any fruit and therefore he is not in a position to apprise the court about the current status.

In the present case, court auction of the property was challenged under Order 21 Rule 89 of the Code of Civil Procedure. Auction amount as well as 5% of purchase money was deposited by the judgment debtors. In fact, the auction was in two parts. The auction purchasers have been refunded the auction amount. The only dispute is whether Beant Singh, one of the auction purchaser is entitled to further 5% of the amount or not?
