Civil Revision No.1433 of 2015 Date of decision: 27.02.2015 Nirmal Singh ....Petitioner

Versus

Banwari Lal

...Respondent

CORAM: HON'BLE MR.JUSTICE G.S.SANDHAWALIA Present: Mr. H.P.S.Ghuman, Advocate for the petitioner. **** G.S.Sandhawalia J.(Oral) Prayer made in the present revision petition filed under Article 227 of the Constitution of India is for directing the Executing Court to deliver the possession of the property in a time bound manner as per order passed by this Court in Civil Revision No.1561 of 2012 decided on 02.09.2013 (Annexure P1). It is not disputed that after the said order was passed, an application under Order 21 Rule 11 CPC for execution of the decree has been filed by the petitioner. The zimini orders have also been reproduced, perusal of which go on to show that matter is pending before the Executing Court and now is fixed for 30.3.2015.

In such circumstances, once the matter is already pending before the Executing Court in pursuance of the execution proceedings filed by the petitioner, no further orders are called for as matter is to be decided by the Executing Court after hearing the parties concerned. However, keeping in view the fact that the decree is dated 16.10.2000, the Executing Court is expected to make an endeavour to decide the execution proceedings at the earliest.

Accordingly, the present revision petition is disposed of with the aforesaid observations.
