The petitioner seeks for modification of the maintenance awarded at `4000/- for the wife and `2000/- for the kids @`1000/- each. The petitioner's assertion in the petition is that the husband is working as medical representative and he is earning `40,000/- per month. The respondent denied his status as medical representative and had stated that he is merely earning `6000/- and has produced the copy of salary certificate. The Court has observed that it cannot be relied on and an able bodied person can make enough income to support a wife and children to provide them `6000/- per month. 2.
It is also seen to be brought on record that two years prior to the petition, there had been an order passed by the Magistrate under Section 125 Cr.P.C awarding a maintenance of `2500/-. The amount of `6000/- which has been determined now shall be taken as including the amount of `2500/- and cannot be taken as an addition to what has been PANKAJ KUMAR 2016.03.21 16:15 I attest to the accuracy and integrity of this document
