AMIT RAWAL J. (Oral) Learned counsel for the petitioner refers to the judgment passed by this Court in CR No.1349 of 2013 titled as Shri Ram General Insurance Company Limited versus Permanent Lok Adalat (Public Utility Services) Gurgaon and another, decided on 7.12.2015 and submits that the matter is squarely covered by the aforementioned judgment of this Court.

I have heard learned counsel for the parties and am of the view that the issue raised in the instant petition is no more res integra in view of the judgment passed by the Hon'ble Apex Court in United India Insurance Co. Ltd. vs. Ajay Sinha and another 2008(7) 454, as well as, by this Court in Shri Ram General Insurance Company Limited's case (supra).
