To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
There is no justification to arrive to this Court to contend that the documentary evidence has not been received and his side has been ordered to be closed. If oral evidence has been given and the documents which he wanted to rely on could not be produced, he shall file an application setting out reasons as to why he could not produce the documents and setting out reasons again as to why case must be examined with reference to the documents by pointing out to the relevancy of the same. If the petitioner explains the above fact and the Court is of the view that the documents are relevant and there was justification for non-production of the same on the day when the case was posted, the order closing the evidence will be recalled and the party will be given an opportunity to produce such evidence as it desires. 2.
The revision petition is dismissed but with the liberty as above.
