The petitioner who has made reference to the fact that one Gurcharan Singh was alive seeks for a modification to state that he was dead and also sought to file a death certificate along with his application. The Court has allowed the application for amendment. 2.
The counsel appearing for the petitioner states that this amendment cannot be made. If the assertion made by the plaintiff on the basis of which amendment was made, was supported through public document such as a death certificate, the application is bound to be allowed and I will find no reason for interfering with the same. 3.
The civil revision petition is dismissed. However, on the basis of the additional evidence let in if the defendant wants to refute and give his own version, the defendant will also be permitted to adduce his own evidence.
