Notice of motion.

Mr. Ameet Awasthi, Advocate, appearing for the caveator, accepts notice on behalf of the respondent.

After arguing the matter at length, the matter has been amicably settled by the parties as per following terms:- (i) The petitioner will vacate and hand over vacant possession of the demised premises to respondent-landlord on or before 31.10.2018.

(ii) The petitioner will pay mesne profits @ `25000/- per month from the date of passing of order by the Appellate Authority till 31.10.2018.

(iii) The amount of mesne profits will be adjusted in the outstanding amount as per order of learned Rent Controller and on handing over the keys of demised premises, the petitioner will be paid balance, if any, out of the amount, Jitender Kumar 2018.02.26 15:36 I attest to the accuracy and integrity of this document Chandigarh

CR-1052-2018 -2which has been ordered to be refunded by learned Rent Controller.

(iv) The petitioner will file affidavit before the Rent Controller within four weeks undertaking to vacate and hand over the vacant possession of the demised premises to the respondent-landlord on or before 31.10.2018.

In case of default of any of the above terms, the respondentlandlord will be entitled to execute the order of ejectment against the petitioner-tenant forthwith.

Instant revision petition is disposed of in view of above terms of settlement between the parties.
