The learned Senior Counsel appearing on behalf of the tenant-petitioner in response to an application for determination of mesne profits drawn at the instance of the landlord has submission to make that he will be satisfied if the Court grants him sufficient time to relocate himself to some other place. He is not interested in contesting the case. The counsel appearing on behalf of the landlord states that rent is being paid at ` 18,000/- per month while the rentals now are as high as ` 1,85,000/- in the vicinity. This is, however, contested by the learned Senior Counsel appearing on behalf of the petitioner as would be in any way a comparison for his own premises which is far smaller than the property which is cited by the landlord. Having regard to the rival contentions of the parties and the restriction of the contention as PANKAJ KUMAR 2015.04.24 16:48 I attest to the accuracy and integrity of this document
C.R. No.2311 of 2010 (O&M) -2confined only to the discretionary powers of this Court in providing to the tenant a reasonable time to relocate himself, I allow for a period of four months to vacate the premises. The petitioner would give an undertaking within one week from the date of receipt of copy of this order in the registry ensuring that he will vacate the property in the manner directed failing which the time granted shall be taken as withdrawn to put the order of eviction to immediate application. 2.
The civil revision is disposed of as above.
