Surinder Gupta, J. (Oral) CM No. 19648-CII of 2016 This is application filed by respondent no. 1 for preponing the date of hearing in the revision petition. Learned counsel for the petitioner has no objection if the application is allowed.

In view of submissions of learned counsel for the parties and for the reasons stated in the application, which is supported by affidavit, the same is allowed and revision petition, which is fixed for 12.12.2016, is preponed and taken up on board today itself for hearing. CR No. 1530 of 2016 This is petition by defendant in civil suit filed by respondent no. 1, seeking opportunity to cross-examine the plaintiff, which was denied by trial Court for the reason that petitioner failed to cross-examine him despite grant of several adjournments.

CR No. 1530 of 2016 -2Learned counsel for respondent no. 1 has no objection if the petitioner is allowed one opportunity to cross-examine plaintiff subject to payment of costs.

Without going into merits of petition and in view of submissions of learned counsel for respondent no. 1, one more opportunity for cross-examination of plaintiff is allowed for 29.10.2016, the date already fixed before the trial Court on payment of `5000/- as costs, which will be deposited with the District Legal Services Authority, Barnala.
