Present revision petition emanates from orders passed by two courts below whereby application filed by plaintiffs-petitioners for interim injunction to restrain the respondents from raising construction or alienating the property has been rejected.

Learned counsel for the petitioners emphatically submits that in case respondents are allowed to raise construction or alienate the property it will cause irreparable loss to the petitioners. Learned counsel for the respondents at the outset submits that respondents have no intention to alienate the property during the pendency of the civil suit.

I have heard learned counsel for the parties. It appears that suit instituted by plaintiffs-petitioners for partition of the land is already pending before the revenue court. Needless to observe that in case any construction is raised by any party, same would be at his risk and cost. CR No. 1534 of 2016 made by respondents that property would not be alienated during the pendency of suit.
