The civil revision petition is not appropriate remedy in a situation where the Court has closed the evidence for non appearance of the plaintiff. The procedure is to apply to the very same Court to recall the order by making appearance in the Court and explain the reason as to why he could not be present. The procedure of how the matter will be dealt with has been considered by this Court in Santosh Kumari Berry Vs. Nirmala Devi and others in C.R. No.5639 of 2012 dated 25.09.2012.
2.
The civil revision petition is dismissed but with liberty to exhaust the remedy in the manner outlined in the said judgment. (K. KANNAN) JUDGE March 04, 2015 Pankaj* PANKAJ KUMAR 2015.03.09 16:08 I attest to the accuracy and integrity of this document
