The Gram Panchayat is aggrieved about the nature of injunction granted by the Court below. Its contention is that the injunction must have been restricted only to the protection against eviction except in due course of law since the plaintiff himself has pleaded that the property belonged to the Gram Panchayat. 2.
Interim order of injunction must be understood that the injunction shall operate till he is duly evicted in due course of law. The plaintiff shall not be entitled to plead that interim order obtained will debar the Gram Panchayat from taking action for eviction in accordance with law. I do not think a notice is necessary, for I am merely stating an obvious in the light of the contentions made by the plaintiff himself admitting the Gram Panchayat to be the owner. The impugned order is clarified to operate in the manner referred to above. The revision petition is disposed of.
