IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT
CHANDIGARH C.R. No.1582 of 2016 Date of Decision.17.03.2016 Pankaj Garg .......Petitioner Vs.
Dikshika Aggarwal ........Respondent
Present:
Mr. Kamal Narula, Advocate for the petitioner.
CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
A person who gives an advertisement that he is earning `1 lac per month and invites a prospect of marriage pleads indigency and states that he is not in a position to pay the amount as claimed by the wife. His own advertisement was justifiably taken by the Court for determining maintenance. He will hang by his own petard by a statement that he has made and a plea that he is not earning and he has no income is rejected. The order passed already is sustained. 2.
The counsel says that the wife is doing interior decoration and making a living. She need not be begging on the road before she claims maintenance. If she is doing any work to lead a respectable living, it ought not to be seen as a point against her to decline her maintenance.
3.
The revision petition is dismissed.
