The petitioner has filed the present petition under Section 482 of the Code Criminal Procedure, 1973 (hereinafter referred to as "the Cr.P.C."), for issuing directions to the respondent No. 1 to 8 to register an FIR against the respondent no.11 to 14.

In substance, the petitioner alleges that he dealing in the construction materials like sand, stone and cement from a shop. On 28.10.2021 the respondent No.11 to 14 came along with a JCB machine and removed the construction material, which was stacked outside the shop, in the trucks. Before leaving, the respondents also damaged the remaining construction material. The petitioner alleges that in spite of the representations, so filed, the respondent No.1 to 8 have failed to register an FIR.

This Court has considered the submissions. In the opinion of

Criminal Misc. No.M-2145 of 2022 the Court, this is not a fit case to exercise the jurisdiction under Section 482 Cr.PC. Hence, the petitioner is relegated to the alternative remedy of filing the complaint before the Court of the concerned Judicial Magistrate of the area.

With the observations made above, the present petition is disposed of.
