A hopeless representation through counsel before the Court below is cause for equally hopeless order passed by the Judge. A Presiding Officer to state that he has no power to recall an order when the side was closed when there is judgment directly against it passed by this Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013

(1) PLR 404, requires no notice to be issued. 2.

I dispense with notice, set aside the order and direct the opportunity to be given to the petitioner on payment of `5,000/- as costs to the defendant. The amount shall be paid within a period of two weeks from the date of receipt of copy of this order failing which the order passed already shall stand restored. The revision petition is allowed on the above observations.
