Learned counsel for the petitioner submits that he will be satisfied if there is an issue of limitation framed by the Court below and he will not press for disposal of the same as preliminary issue. The bar of limitation is always to be considered by a Court with or without a specific plea therefor in terms of Section 3 of the Limitation Act. I, therefore, direct the following issue to be framed by the Court dispensing with notice to the respondents to ensure that there is no delay on this score:

"Whether plaintiff's prayer for setting aside decree obtained against the plaintiff's mother is barred by limitation ? OPD 2.

The civil revision is disposed of as above.
