Learned State counsel, although opposes the bail plea of petitioner, however on instructions from Assistant Sub Inspector Gurtej Singh, he fairly concedes the fact that no recovery was effected from the petitioner. He further does not refute the factum of grant of regular bail to the co-accused of petititoner, 5 7 ? ? :? ? from whom the recovery was alleged to be
effected in this case, by a co-ordinate Bench of this Court. Further, 9 !
5!! 5 5 ! I have heard learned counsel for the parties and have perused the paper book as well as the custody certificate handed over by learned State counsel, in Court today.
As per custody certificate dated 17.01.2023, the petitioner has undergone 2 months and 18 days of custody and he is 5 ! &! 5 !5 9 ! &1!!

Keeping in view the aforementioned circumstances, the instant petition is allowed and the petitioner is ordered to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate concerned. However, the concerned Station House Officer shall be informed about the release of petitioner and he shall inform the concerned Station House Officer about his address at which he intends to reside during the pendency of case and any change in the address shall also be communicated to the concerned Station House Officer, forthwith. The petitioner would also furnish his telephone number to the concerned Station House Officer. He would also furnish his undertaking to the effect that he will not indulge in any illegal activity.
