(Oral) This is a petition challenging the order of issuance of warrant of possession on the ground that the application under Order 9 Rule 13 CPC is pending. Learned counsel for the respondent-tenant states that in case the petitioner deposits the entire due rent (at the rate on which the last rent was paid) within a period of one month he would not oppose this petition. Learned counsel for the petitioner has accepted this.
Resultantly this petition is disposed of with a direction that in case the petitioner pays the entire rent as aforesaid on or before 29.02.2016 his application Under Order 9 Rule 13 CPC would stand allowed and the case shall proceed further. In the circumstances the trial Court will adjourn the case up to 29.02.2016 and in case the petitioner makes the entire up-to-date payment as aforesaid he would take on record its reply.
